Terms of Use

These Terms of Use (“Terms”) are a binding agreement between you and Listed (“Listed,” “we,” “us”) governing your use of our mobile app and the website at listedapp.ai (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 13 years old to use Listed. If you are under the age of legal majority where you live, your parent or legal guardian must agree to these Terms on your behalf. You may not use the Service if you are barred from doing so under any applicable law.

2. Your account

  • You are responsible for safeguarding your account and for everything that happens under it.
  • You agree the information you provide is accurate and that you will keep it up to date.
  • One account per person. You may not impersonate anyone else or misrepresent your affiliation.

3. Listed Access subscription

Listed Access is an optional auto-renewing subscription that unlocks premium features (such as the verified badge and the digital membership card).

  • Price + duration. US$9.99 per month, billed monthly through your Apple ID.
  • Auto-renewal. Your subscription renews automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before the period ends.
  • How to cancel. Manage or cancel your subscription on your device: Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period.
  • Refunds. Refunds are handled by Apple. Contact reportaproblem.apple.com. Where required by law, you may have additional refund rights.
  • Price changes. If we change the price, we will notify you in advance and you may cancel before the new price takes effect.

4. Paid events

Hosts may charge for tickets to events through the Service. Payments are processed by Stripe. Listed keeps a service fee; the remainder is paid out to the host. Refunds for paid events are at the host's discretion unless required by law. Listed is not a party to the underlying event, is not the merchant of record for the host, and is not responsible for what happens at the event.

5. Your content

You keep ownership of the content you post on Listed (photos, videos, text, audio, events). By posting, you grant Listed a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (e.g., resize images), and display your content within the Service and as part of any feature that requires it (your own feed, your followers' feeds, search, the discovery surface). This license ends when you delete the content or your account, except where we need to retain it for legal compliance or for backups.

You represent that you have all necessary rights to the content you post and that it does not infringe anyone else's rights.

6. Content rules

You may not post or send content that:

  • Is illegal, threatens or harasses anyone, or promotes violence.
  • Sexualizes minors, depicts non-consensual intimate imagery, or otherwise sexually exploits any person.
  • Promotes hate based on race, ethnicity, national origin, religion, disability, gender, sexual orientation, or gender identity.
  • Contains spam, scams, malware, or deceptive content.
  • Impersonates another person or violates their privacy.
  • Infringes anyone's intellectual property rights.

Public content is screened by our automated moderator. If your content is removed, you may appeal in the app — a human reviewer will look at it. We reserve the right to remove any content for any reason and to suspend or terminate accounts that repeatedly violate these rules.

7. License to Listed

Subject to your compliance with these Terms, Listed grants you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the app for your own non-commercial use. You may not copy, modify, reverse engineer, sell, or sublicense the app, nor use it to build a competing service.

8. Acceptable use

You agree not to:

  • Access the Service through automated means (scrapers, bots) without our written permission.
  • Interfere with the Service, attempt to gain unauthorized access, or probe its security.
  • Use the Service to send unsolicited commercial messages.
  • Use the Service in violation of any law or these Terms.

9. Termination

You can delete your account at any time from inside the app. We can suspend or terminate your access if you violate these Terms, if your account creates legal risk for us, or if we discontinue the Service. On termination, the rights you have under these Terms end. Sections that by their nature should survive termination will survive (including ownership, indemnity, disclaimers, limitation of liability, and dispute resolution).

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content posted by others is accurate or reliable.

11. Limitation of liability

To the maximum extent permitted by law, Listed and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, revenues, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim under these Terms is limited to the greater of US$100 or the amount you paid to Listed in the twelve months before the claim arose.

12. Indemnity

You agree to indemnify and hold Listed harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your content, your violation of these Terms, or your violation of any third party's rights.

13. Governing law + disputes

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction there. Where required by law, this section does not affect any rights you have as a consumer that cannot be waived by agreement.

14. Apple-specific terms

If you downloaded the app from the Apple App Store, the following also applies:

  • These Terms are between you and Listed, not Apple. Apple is not responsible for the app or its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
  • Apple is a third-party beneficiary of these Terms and may enforce them against you.
  • You represent that you are not located in a US-embargoed country and are not on any US-government denied-parties list.

15. Changes

We may update these Terms from time to time. If we make material changes we will notify you in the app or by email at least 7 days before they take effect. If you keep using the Service after the changes take effect, you accept the new Terms.
